Appraiser’s Guide to Highest & Best Use (4hr)

Course Description

Highest and best use analysis isn’t just a cut-and-paste recipe. It’s a logical decision-making process for appraisers, a series of hypotheses you’ll test against the facts on the ground. Think of yourself as a detective on a case: Assume nothing. Ask the four big questions:

  • Do zoning laws and other regulations permit the proposed use?
  • Can the structure physically be built on this property?
  • Will it make money?
  • Which of the feasible uses provides the most benefit?

Collect evidence. Support your findings. Most of all, keep an open mind as you seek answers. This is a critical part of your analysis, and it plays an immense role in making your real property appraisal credible. In this course, you’ll learn how to apply the four tests and make your H&BU analysis count.

Meet The Instructors

Course Instructor

MJ Carroll

Michael “MJ” Carroll, MNAA, is the Principal Appraiser and founder of MJ Valuations, Inc., with over 35 years of residential appraisal experience across Southern California and, since 2016, Colorado. He began his career in 1987 with Home Savings of America and, by age 26, became the youngest district manager in Bank of America’s appraisal division. MJ has consistently ranked among the top producers nationally, specializes in complex property assignments, and has developed a broad network of clients—including lenders, attorneys, and real estate professionals—to deliver reliable valuation services .

An active leader in the profession, MJ serves as President of the Colorado Coalition of Appraisers, sits on the Board of the Colorado Association of Real Estate Appraisers, and is a member of the National Association of Appraisers. He holds an Associate of Arts in Real Estate from El Camino College and pursued Speech Communication studies at California State University, Long Beach

Hal Humphreys

Hal Humphreys is a real estate appraiser with more than 30 years in the business. He has served as an expert witness in civil and criminal cases where citizens (many times, appraisers) were accused of fraud or negligence and as a contract investigator for the Tennessee Department of Commerce and Insurance. Hal is a founding partner of Appraiser eLearning.

CE/Attendance Requirements:

  • Computer audio/video, reliable internet, and 100% attendance are required for CE credit.
  • ABSOLUTELY NO DRIVING (OR RIDING) IS ALLOWED.
  • You must be attentive, stationary (no walking or being a distraction) and visible on camera.
  • If you become a distraction, we will remove you from class.

  • If you are taking a USPAP update course, have the current USPAP publication on hand.

  • Remember: you must be present with your camera on 100% of the class time. (This is a state requirement, not ours. We cannot make exceptions.)
  • Refunds require a 24-hour written notice.
  • BUT if you miss class and forget to notify us, no worries! Just reach out to our team, and we’re happy to transfer you to a later class.
  • We can only provide one transfer, so if you miss the second class, you will not have the option for a transfer and will forfeit the purchase cost.

  • You must be visible and prepared to answer instructor questions (please do not drive, work on other tasks, walk your dog, or anything else that might be distracting to the class).

  • Once you complete the evaluation, you’ll receive an emailed certificate from our LMS. Please keep in mind that failure to complete this survey will delay your certificate (it is REQUIRED).
  • If you have any issues with the automated certificate, just reply to Ben’s Course Evaluation email and request a PDF copy.
  • If you’re in a state that requires the provider to report on your behalf, we will report your CE after class. Please give us 24 hours to do so. (States in which we report on your behalf include: FL, GA, IL, NC, NV, OH, SC, TX, and UT.)
  • If you have any questions, the instructor and class moderator will stick around for a few minutes after class ends.
